Avery Ennis LLC ("we," "us" or "AELLC"), the provider of the BillCosby.com web site ("Site"), respects your privacy. This Privacy Statement ("Statement") describes what information we collect when you visit the Site, how we use it, and how you can modify or delete it. This Statement is part of the Terms that govern your use of the Site, so please read the entire Terms.

By using the Site, you consent to our collection and use of information about you in accordance with this Statement. We may change this Statement in our sole discretion by posting an updated version of it on this page, and the changes are effective immediately upon posting. If we decide that it is appropriate, we may also provide additional notice of more significant changes. By continuing to use the Site after we post an updated Statement, you agree to the updated Statement.

Personal Information We Collect

We collect personally-identifiable information about you only when you voluntarily provide it to us ("Personal Information").

For example, when you create a Cosby Treasures shopping account ("Treasures Account"), we collect information about you such as your name and email address, and when you make any purchases under your Treasures Account, we collect additional information, such as your billing and shipping addresses, telephone numbers, and credit-card number and expiration date. Using features available on the Site, you can choose whether to retain certain information (such as your addresses and credit-card information) under your Treasures Account for future transactions. Please note that even if you do not choose to save information for future transactions, we may retain your information for transaction-history, dispute-resolution, and similar purposes. We also collect your credit card’s security code as part of each pending transaction, but retain it only for that session until the transaction has been approved.

Similarly, when you create a Cos Communities member account ("Communities Account"), we collect information about you (such as your email address and your birth year to verify eligibility to participate). Your Communities Account also allows you to supply optional Personal Information (such as your gender, location, and biography) for your member profile. This profile, which also includes the user name and graphic icon you choose for your Communities Account, will be publicly available on the Site and could be used to identify you. You should not include any Personal Information in your member profile or User Content (as defined in the Terms) if you do not want to make that information available to others. Any Personal Information that you make publicly available on the Site is not considered confidential, and we are not liable or responsible for how others may use it.

In addition, we may receive your Personal Information from our third-party service providers that provide additional online services if you have opted in to have your information shared with us. You should use the third-party services only when you have reviewed and agreed to the third-party service provider’s terms of use and privacy policy.

How We Use Your Personal Information

If you provide Personal Information, we will use it for the purposes for which you provided it. For example, the information you provide under your Treasures Account is used to process, fulfill, and communicate with you about your Cosby Treasures orders. It may also be used to handle other matters related to your purchase, such as shipping issues or billing disputes. Similarly, the information you submit under your Communities Account is used to maintain your registration and to facilitate your participation in the Cos Communities and related features of the Site.

We may also use your Personal Information to send you material about products, services, and activities that we or our affiliates think may be of interest to you. If you do not wish to receive one or more types of communications from us, you may notify us at unsubscribe@BillCosby.com or, if applicable, follow the instructions included in the materials we send you, such as an "unsubscribe" link provided in an email message. (Note that you may not opt out of receiving certain important communications related to your Communities Account, Treasures Account, and Cosby Treasures orders. If you no longer wish to receive any communications whatsoever, please send us an email from the email account you gave us and request that your account be deleted.

Third-Party Information

From time to time, the Site may have features that allow you to send communications related to the Site to third parties, such as your friends and family. For these features to operate, the Site will collect contact information from you about those third-party recipients ("Third-Party Information"). We will not use this Third-Party Information for any purpose other than to send the communications you have initiated. We may keep a record of the Third-Party Information for a period of time in case we decide we need to resolve problems related to the communications. If the third-party recipient wishes to have information about him or her deleted from our records, the recipient should contact us at service@billcosby.com.

Non-Personal Information

We also may track and record certain non-personal information about Site users ("Non-Personal Information"), including the type of web browser used, he time and date of visits, the pages of the Site that are viewed, and the time spent on a particular page. We may use aggregate Non-Personal Information to analyze web traffic analysis to help us understand how visitors use the Site and which pages are most popular and to improve the Site and for similar purposes. We do not use this Non-Personal Information to identify or track specific users, but we reserve the right to do so for safety or security reasons, for purposes of investigating a violation of the Terms or applicable law, or for other purposes we determine in good faith are appropriate.

Sharing of Your Information

We may share your Personal Information, Third-Party Information, and Non-Personal Information with our affiliates or with third parties who provide services in connection with the Site and the products and services available on it. For example, we must share your shipping address with the carrier who will deliver Cosby Treasures products to you, and we must share necessary credit-card information with the appropriate credit-card company to process your order.

We also reserve the right to disclose and use Personal Information, Third-Party Information, and Non-Personal Information in special circumstances, including: to enforce this Statement or other Terms; to protect the property, rights and safety of any one; to detect or prevent potential or actual fraudulent or unlawful activity; in connection with a sale or transfer of some or all of our assets; or for other reasons we determine in good faith are necessary, appropriate, or required by law.

Cookies

Some parts of the Site rely on cookies, which are small data files placed on your computer to enhance your use of the Site. For example, when you log in to your Communities Account or Treasures Account, you can choose "Remember Me" so that you do not have to re-enter your login information when you return to the Site using the same computer. (Note that making this choice may enable other users of that computer to access your Accounts.) You can disable the cookies function, or delete existing cookies, through your web browser’s options, but doing so may affect the Site’s functionality.

Other Sites

For your convenience, the Site may contain links to web sites owned or controlled by third parties. Those sites’ privacy practices may differ from ours, and we are not responsible for them. We encourage you to read the privacy statement of any web site you choose to visit.

Children Under Age 13

We do not knowingly collect any information from children under age 13 through the Site. If you discover that we have collected information from a child under age 13, please notify us at service@billcosby.com. If a child under age 13 sends us an email with a question or comment, and we are aware of the child’s age, we may respond using that email address but we will not keep the email address or use it again.

Enforcement

If we become aware that the security of the Site has been or may be compromised or any nonpublic user information has been or may be disclosed to unrelated third parties as a result of external activity or otherwise not in accordance with this Statement, we will take measures that we deem appropriate (which may include undertaking an internal investigation, notifying the user, and notifying and cooperating with law enforcement authorities).

Security

We endeavor to use reasonable efforts to safeguard Personal Information that you provide through the Site, including by using encryption when transmitting credit card numbers. Nevertheless, no transmission over the Internet can be guaranteed to be 100% secure, and third parties may intercept information without authorization. We make no representation or warranty that the Site is protected from viruses, security threats or other vulnerabilities or that your Personal Information or Non-Personal Information is always secure. Accordingly, you provide us with your Personal Information and Non-Personal Information at your sole risk.

Location of Servers and Transfer of Information

Our servers are located in the United States. If you are located outside of the United States, please be aware that any information you provide to us will be transferred to the United States. By using our Site or providing your Personal Information to us, you consent to this transfer and to the collection, storage, processing, and use of your Personal Information in the United States. In addition, if you are located in the United States, our service providers may not be located in your geographic area in the United States. By providing your Personal Information on the Site, you also consent to the transfer of your data to these service providers.

Reviewing and Updating Your Personal Information

To update, delete, or correct your Personal Information, please contact us at service@billcosby.com. You may also be able to review and to update, delete, or correct some Personal Information in your Accounts directly through the Site.
